1. Acceptance of Terms
By accessing or using any website, application, or service operated by Pretzinger Group, The Insurance Dudes, or Pretzinger Agencies (collectively, “Company,” “we,” “us”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use our services.
2. Services
Pretzinger Agencies is a licensed insurance agency offering home, auto, and other personal lines coverage. Pretzinger Group and The Insurance Dudes provide insurance industry content, education, and related services. We may contact you via telephone, text message (SMS/MMS), and email in connection with the insurance products and services you have inquired about.
3. Telephone Consumer Protection Act (TCPA) Consent & Disclosures
SMS/Text Message Consent. By providing your phone number and checking the consent box on one of our forms, you agree to receive SMS/text messages from Pretzinger Agencies regarding insurance quotes, policy review reminders, renewal follow-ups, appointment reminders, customer care, and marketing messages related to insurance products and services, including home and auto bundle quote opportunities. You are opting into marketing texts only if you select the marketing text message option. We will not share or sell mobile information with third parties for promotional or marketing purposes, or for any other reason.
Consent Not Required for Purchase. Your consent to receive text messages is not a condition of purchasing any goods or services. You may choose not to provide consent and still inquire about our services by contacting us directly.
Message & Data Rates. Standard message and data rates may apply to any text messages sent or received. Message frequency may vary.
Opt-Out. You may revoke your consent at any time by replying STOP to any text message. Reply HELP for help. You may also call us at the number provided in our communications or email optout@pretzingergroup.com. Upon receipt of your opt-out request, we will stop sending text messages to the number(s) you specify within a reasonable time.
Caller Identification. When we place outbound calls, we will identify ourselves and the purpose of the call at the beginning of the conversation.
Calling Hours. We will not place telemarketing calls before 8:00 AM or after 9:00 PM in the recipient's local time zone, in accordance with TCPA and applicable FCC regulations.
Do-Not-Call. We maintain an internal Do-Not-Call list and honor all requests to be placed on it. We also comply with the National Do-Not-Call Registry maintained by the Federal Trade Commission (FTC). If you wish to be added to our internal Do-Not-Call list, please contact optout@pretzingergroup.com.
4. Your Information
When you submit your information through one of our forms, it is used by Pretzinger Agencies to respond to your request, prepare quotes, and service your policy. Where needed to quote or issue coverage you have requested, we submit the relevant details to the insurance carrier(s) we represent.
We do not sell your personal information, and we will not share or sell your mobile phone number or text messaging opt-in data with third parties for promotional or marketing purposes, or for any other reason. See our Privacy Policy for details.
5. Disclaimer of Warranties
Our services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee coverage, rates, or approval of any insurance product. Insurance products are subject to underwriting guidelines and approval by the issuing carrier.
6. Limitation of Liability
To the maximum extent permitted by law, Pretzinger Group and its subsidiaries shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.
7. Indemnification
You agree to indemnify, defend, and hold harmless Pretzinger Group and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or your violation of these Terms.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.
9. Changes to Terms
We reserve the right to update these Terms at any time. Changes are effective upon posting. Your continued use of our services constitutes acceptance of the revised Terms.
